DUI-Attorney News: Police Arrest Judge for Drunk Driving

For example, when Gisele Pollack first became a judge, she was very open about her history of alcoholism. Early in the morning, police responded to a two-car accident. Paramedics took the other driver, Dylan Razack, to the hospital with a serious neck injury.

While interviewing Pollack, the responding officer reported smelling alcohol on her breath and it was clear that she was not following the 12 principles of AA.

He asked her to take a field sobriety test, which she failed. Afterward, she told the officer she would not take a breathalyzer test and began crying, telling him that she did not want to be arrested.

In December, courthouse staff noticed that Pollack was drunk and tried to convince her to go home. She tried to fire one staff member, and another judge needed to intervene in order to get her to leave.

Since then, Pollack has attended a rehabilitation program, but her attorney says recent problems in her family life may have caused her to relapse. Specifically, her son is struggling with serious medical issues, and her mother recently died.

This arrest could mark the end of Pollack’s career. She may gain some sympathy in court for her efforts to get sober, but the Judicial Qualifications Committee may decide that she is no longer fit to be a judge.

Assuming this is her first DUI, she faces a short jail sentence, fines and a license suspension. However, her penalties may increase because of the injuries and property damage involved in the crash.

The Punishment for DUI May Soon Include Daily Breath Tests

According to the Orlando Sentinel, the state legislature is considering a bill that would allow judges to sentence drinking-and-driving offenders to daily breath testing. Currently, judges use ignition interlock devices to prevent them from driving drunk.

The new bill would help judges address the root of the problem by promoting total sobriety. Supporters of the law say that the abstinence program would lower the risk of repeat offences and could even reduce the number of other alcohol-related crimes, like domestic abuse.
